The officer that arrested Sandra Bland isn’t responsible for her death. As of now, all evidence points to her death as being a suicide. However, what is perfectly clear – thanks to the newly released dashcam video – is, that there was no probable cause to arrest her. For that, he should be held accountable. Particularly, because he lied in his initial report as to how the traffic stop and arrest played out.

Yes, he lied.

It could be argued that Sandra Bland would still be alive if she was never arrested. Which, may be a natural stance for one to take. But again, for now, the focus should be on the violation of her rights; and, it should be used as a teachable moment. Why? Because if we continue to walk away from these stories without learning anything – other than that some cops lie – then I’d say that we’ll forever be in trouble.

Look, it’s important to know your rights. Equally as important is knowing how to articulate and exercise your rights in any encounter or exchange with law enforcement. That should be the only thing that comes out of your mouth in situations when you encounter the police. How or the manner by which you choose to do so is totally up to you. However, I would advise anyone reading this to do so in a calm and respectful manner. Not that to do so will determine whether you’re arrested or not. But, nonetheless, let’s just say that doing so helps to make what for many exists as a very tense situation with much suspicion and implicit biases on both sides of the fence.

This may sound like victim-blaming, but it isn’t. That is unless you’re content to walk away not learning tools that could be the difference between life and death. And, I don’t know about you, but I’m tired of seeing this stuff in the media without the proper discussion of the rights of citizens involved in police encounters. Which is sad, because you shouldn’t have to be a card-carrying member of the ACLU to understand.

And, if this bothers you like it does me, just imagine how many times similar situations play out across the country without ever making the news. Sandra Bland being dead of an apparent suicide should not be yet another one of those squandered moments.

We can march and protest all we like until our feet fall off. But, until we start teaching people that they have a constitutional right to never talk to the police – yes, it’s called the Fifth Amendment of the U.S. Constitution – or, answer questions from police officers without an attorney present. Then and only then can we have conversations about police accountability without having silly debates about the behavior of citizens like Sandra Bland, over whether it contributed to her demise when the issue happens to be overzealous lying ass cops with a penchant for abusing their authority.

To be honest, Sandra Bland’s “attitude” didn’t lead to her demise. Instead, it was her failure to follow a lawful command per the 1977 U.S. Supreme Court ruling in Pennsylvania v. Mimms to exit her car that as probable cause for her arrest. Yes, Sandra Bland had every right to voice her displeasure with the officer in whatever manner prior to being ordered to exit her car. But make no mistake, though it may be hard to say amid all the noise, that’s the reason Sandra Bland was arrested.

Her arrest had nothing to do with her refusal to put out her cigarette when she was asked by the officer. And yes, she was asked and not commanded to put out her cigarette. The officer made a request, and she was within her right, at that point, to refuse to acquiesce. To some this may have seemed like a big no, but it isn’t.

Having said hat, as a person of color, I’d be remiss if I didn’t emphasize the importance of not talking to the police, or answering any of their questions. It’s important to allow them to do their jobs while keeping your mouth shut during a traffic stop except to ask, “Am I being detained, or am I free to go?” If you feel the need to challenge the conduct and actions of an officer, you’re better off doing it by filing a complaint with his superiors – or even filing a lawsuit – rather than having an argument about it in the street. Nine times out of ten, should you choose to do the later, you will lose.

Because there will not always be someone with a camera-phone or even a working police body cam around it’s important to keep the following tips in mind:

  • Always keep your hands where they can be seen – make no sudden moves
  • Never completely roll your window down
  • If asked to exit your car, be sure to lock your doors after doing so
  • Do not consent to a search – they have to ask you
  • Most importantly, keep your mouth shut

ray-tensing-sam-dubose-sandra-blandBy now I’m sure you’ve seen the video of Sam DuBose being killed by a University of Cincinnati police officer, Ray Tersing. As was the case in the murder of Walter Scott in South Carolina, thanks to video evidence, we now know that like the officer, in that case, this officer has also lied about the incident. What we also know is that at least two other officers on the scene have also lied under oath to a grand jury.

Thankfully, as I mentioned, because of video evidence, the truth of this incident is out. Without it, it would have been easy to sweep the death of Sam DuBose under the rug. Without video evidence, Sam DuBose would have been just another thug who had to be killed because he posed an imminent threat to the life of a police officer.

Because of video, we now know that the officer lied.

Additionally, we can see clearly – thanks to the video – that Sam DuBose didn’t have an “attitude”, nor was he belligerent when he communicated with the officer. So yes, because of this, it can be argued that whether or not one gives a cop “attitude” like Sandra Bland, for people of color the outcome always seems to b the same. That would be, that we’ll always end up dead or in jail. It’s a rather cynical position, to be sure.

However, it is for this very reason why a change in policy beyond the use of body cams is necessary. Without the appointment of citizen review boards with full subpoena powers, there’d be no oversight and accountability.

And, of course, we cannot afford to have situations like the ongoing extra-judicial execution of citizens of any color, by the police, to continue. At some point, the change we seek has to go beyond angry social media outbursts, and disruptions by protestors in public spaces. It’s one thing to get the attention of the world if only for a moment.

However, it’s another thing to propose specific policy positions, for which we can hold the feet of politicians on the state and local level to the fire.Without it, there’ll be more stories like these for the media to pimp for profit; and for bloggers like myself to write about. Frankly speaking, I’m sick of it all. The silly conspiracy theories about dead people in mugshots. The debates about personal responsibility. The fight over whether the killing of an African lion is more important than that of cops killing black people.

Yes, I’m fucking sick of it all.

I don’t necessarily trust polling data because I think for the most part people tell you what they think you wanna hear. But at any rate they’re always an interesting snapshot of just how people were thinking at the time; especially when considering the political climate. So here’s the results of a recent poll taken by the folks over at Rasmussen, on just how Americans feel about government being a threat to our constitutional rights:
WASHINGTON, June 24 (UPI) – Nearly half of U.S. adults view the government as a threat to, not a protector of, individual rights, a Rasmussen poll released Thursday indicates.

Forty-eight percent of adults said they saw the government as a threat, compared with 37 percent who said they believed the opposite, Rasmussen said. Fifteen percent of survey respondents said they were undecided.

Most Republicans, 74 percent, said they thought the government threatened individual rights, while 51 percent of respondents not identifying a party affiliation expressed the same view. Sixty-four percent of Democrats regard the government as a protector of rights.

Additionally, most Americans — 52 percent — said they thought it was more important for the government  to protect individual rights than to promote economic growth, the poll indicated. Thirty-one percent of respondents said promoting economic growth is more important.

Results are based on a nationwide survey of 1,000 adults conducted June 18-19. The margin of error is 3 percentage points. (source)OK, so do you see what I mean about not trusting respondents? Isn’t it interesting that the majority of the Republicans respondents are of the belief that government poses a threat to our rights? Yep, the very same people who more than likely supported the last administration as they all but stripped us butt-naked and gave us all anal probes while we sat in the comfort of our own homes.

But lemme guess, there’s a Kenyan-born Muslim with the ability to dance on beat better than 99% of them now occupying the White House, so obviously our individual rights are in jeopardy. Which is really funny because ours is a nation founded on Christianity where God gave all men inalienable rights. That said, why then should anyone feel that the government is a threat against our individual rights?

But this is America, you have the right to be a hypocrite I suppose:

After watching that video, I can’t do anything but to quote the late great Martin Luther King Jr. as he spoke on injustice when he said, “Fuck the police!” Ok, so I’m not sure if that was a direct quote or not, but I’m sure that thought crossed his mind as it has yours at one point or another. It makes me wonder what would you guys do if you were ever put in that situation by someone who is sworn to uphold the law. Me personally? I’d never get myself into that situation. Yes, I would have never been one of the victims in the above news release. You know why? Because I do not talk to cops. Yes, RiPPa is down with the “Stop Snitching Movement” that so many are against.
What RiPPa, you’re one of those ig’nant niggas who support that bullshit?
Yes I am, and I am proud of it. You know why? Because per the constitution I can muthafucka. That’s right; the problem is people talk too damn much. Yup, and when they do, they get fucked by the police pretty much like the people in the video above. Ok, so yeah, I doubt cops all over the country are ganking folks for their unemployment checks. But I do know that the civil rights of people are constantly violated by cops. And you know why they continue to do this? To me, that’s the sad part about this situation; yes, a Black man who is sworn to uphold the law has taken advantage of ignorant minorities. I’d love to see him try that shit on some White folks. I bet his Black ass wouldn’t even dare. Yup, it’s usually Slave Catching Negroes such as the Black cop above who in the position they’re in will knowingly screw another minority.Now wasn’t that cop a bad actor or what? If only they were like this is in real life. Hell, most of them just try to get by on intimidation which only aids them in jamming a nightstick up your ass. Listen up folks, you do not have to speak to the police ever. Lemme be clear, you do not have to speak to the police, or sign any documents without an attorney present. When you do, you often end up being the one the shitty end of the stick. Or worse, curled up beside a Hyundai getting your head bashed in like Rodney King.
In the following video at the end of this post, there’s some valuable information. You’ll see that currently there are innocent people who have had their convictions eventually overturned all because they spoke to the police. I’m not gonna ramble on with this one, but just know that the 4th & 5th amendment protects you from this sort of thing. Yes it does and its up to you the individual to acquire said knowledge of law and the constitution. I say that because when you do go to court, you don’t want a judge to have to tell you that ignorance of the law is no excuse. So yeah watching this next video is all on you. However, I’d like you to share with me any messed up police encounters you may have been subjected to. More importantly, I’d like to know what did you do about it. My best advice for anyone would be seek counsel of the ACLU on matters like these. As a matter of fact, I think it’s a good idea to join their organization. Why? Because freedom cannot protect itself.

The very first of the American Bill of Rights begins, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof . . .” The Supreme Court of the United States has long interpreted the first amendment of the constitution to mean that the government cannot use its enormous resources, power, and influence to favor one religion over others. In this doctrine, the State and the Church must remain independent. This is the principle of “The Separation of Church and State.”
The intention was to prohibit the establishment of a specific state religion and to protect other religions from persecution. Thus, America became a land of religious freedom, tolerance, and diversity.
Again the goal was to protect the religious freedom of all citizens, i.e., the complete freedom of human beings to determine their own religious beliefs, which can only exist if the power of the government is not used to shape the religious beliefs of the citizens. To protect this most holy freedom, there must be NO actions by the State favoring one form of religious belief over any other.
In 1994, this inspired doctrine was clarified further when the Supreme Court concluded that “government should not prefer one religion to another, or religion to irreligion.” The government’s sacred job is to protect the complete freedom of sentient humans to determine their own religious beliefs, and to do so, the government must not enter into the business of promoting any particular form of religious belief.
Many of the religious fanatics who want to do away with the Separation of Church and State actually harbor the paranoid delusion that their most sacred holiday, you know, the one where they celebrate the immaculate conception and birth of God’s son to a virgin by engaging in a frenzied orgy of shopping and consumption is in grave danger! In their conspiracy theory belief system, the dark forces of secular humanism (comprising far less than 10% of the American population) have declared a War on Christmas. And, of course, the Christianity that each such group of religious fanatics propose to make part of America’s legal Constitution just happens to be THEIR particular version of Christianity.
Anyone in the mood for a few hundred years of religious warfare? Apparently, a large segment of the American electorate needs a reminder of what it is like to have governments controlled by one group’s religious point of view.
In the face of such widespread historical ignorance about why the framers of the Constitution felt a need to separate the state from religion, religious freedom cannot be taken for granted. This divine freedom enshrined in the Constitution could be eroded and eventually vanish altogether. For the maintenance of freedom in a democracy to be assured, a better educated electorate is required; the people must have an understanding of the relationship between laws and rights. And the understanding needed for the maintenance of religious freedom in a democracy is diminishing in America.
For example, many Americans found nothing wrong with the Bush Administration’s erosion of the Separation of Church and State when Bush instituted long prohibited government grants to “faith-based” organizations.
And the religious right has been able to generate growing support for another apparently reasonable initiative, one that would supposedly enhance freedom and improve the quality of education: school vouchers.

School Vouchers to the Rescue!

So how do our political leaders respond to the critical importance of education in the maintenance of a robust democracy? In their ostensible concern about the quality of education that children receive in public schools, many of America’s elected officials are now promoting school vouchers. Vouchers will turn taxes collected by the government over to parents who can use them to send their children to the school of their choice.
More freedom! Choice and competition (the almighty engines of the free market) will improve the quality of education! Sounds good, doesn’t it? Yet a little consideration of the consequences should make it clear that this would pose a far greater threat to American democracy than Saddam Hussein with real WMD’s!
The 8yr reign of the Bush administration should make clear, today only a precarious allegiance to the Constitution is maintained by politicians put in place by an electorate that hasn’t much of a clue about the importance of the Separation of Church and State. This precarious allegiance could very well reach “a tipping point” (to coin a phrase). Indeed, school vouchers should enable the religious right to reach their stated (!) goal, the destruction of America’s religious freedom.
Consider this. It is the very same people who want to make the U.S. a “Christian” nation and are terribly concerned about “the carnage” from the War on Christmas who are the most vociferous supporters of school vouchers. Why? Because what will inevitably happen is that an even larger number of families will then be able to afford to remove their children from public schools (that are currently prohibited from fostering any particular religious notions) and send them to private, parochial (i.e., religious) schools.
The end result of such a change in how the government spends/disburses tax money earmarked for education is that many more millions of American children will be withdrawn from secular, public schools and sent to parochial schools. So don’t worry; since parochial schools are believed by some to provide a better all-around education, we can rest assured that the next generation of Americans will have a more thorough understanding of the importance of the Separation of Church and State!

Yeah, right!
